Novartis Spars With Sales Reps Over FLSA Exemptions

Law360, New York (November 19, 2008, 12:00 AM EST) -- Novartis Pharmaceutical Corp. has urged a federal judge to dismiss a wage-and-hour suit brought by the drugmaker's sales representatives, arguing that the plaintiffs were exempt from overtime pay under the Fair Labor Standards Act.

During oral argument on Novartis' motion for summary judgment Tuesday in the U.S. District Court for the Southern District of New York, attorney Richard Schnadig told Judge Paul Crotty that the company's army of representatives was subject to both the administrative and outside sales exemptions under the law and was not entitled...
