Ill. Appeals Court OKs $23M MetLife Fax Case Settlement

Law360, New York (March 24, 2016, 11:43 PM EDT) -- An Illinois appeals court on Wednesday upheld a $23 million class-action settlement resolving claims a former MetLife salesman sent out adverting fax-blasts in violation of federal "do not call" laws, rejecting objections that the fund and the attorneys' fees were too high.

The state appeals panel said the trial court was correct in approving the 2014 settlement, ruling against objectors Judd Clayton Jr., and Austin Distributing, who had claimed the due-process rights of the class had been violated and the attorneys' fees award of $7.6 million was excessive, according to the opinion.
