ERISA Doesn't Preempt Contract Dispute: 9th Circ.

Law360 (November 20, 2008, 12:00 AM EST) -- An appeals court has overturned the dismissal of a contract dispute between a California hospital and a health benefits plan for seafarers, ruling federal employment law does not preempt the plaintiff's state-law claims.

In a ruling issued Tuesday, the U.S. Court of Appeals for the Ninth Circuit found St. Mary's Medical Center's breach of contract claims against Seafarers Health and Benefits Plan were not preempted by the Employee Retirement Income Security Act and remanded the case to state court.
