Judge Squashes Caterpillar Motion In ERISA Suit

Law360, New York (November 24, 2008, 12:00 AM EST) -- Heavy-equipment maker Caterpillar Inc. has lost its motion to stay a preliminary injunction order that enjoined it from cutting health care benefits for a subclass of retirees and their spouses.

In an opinion issued Thursday, Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee ruled that Caterpillar did not show a high probability of success on the merits of the case or on its statute of limitations argument.
