Plaintiff Granted Dismissal In Chantix Class Action

Law360 (December 1, 2008, 12:00 AM EST) -- A putative class action alleging that Pfizer Inc. conspired to conceal facts and evidence regarding potentially dangerous side effects of prescription smoking-cessation drug Chantix was dismissed without prejudice Tuesday, about a week after the plaintiff asked for the dismissal.

According to the judge's order, named plaintiff Donna Myler filed a notice of voluntary dismissal Nov. 21. The notice of voluntary dismissal states that the plaintiff "wishes to maintain her ability to bring suit later should circumstances change and warrant such action."
