Cutera Securities Plaintiffs Plot Appeal

Law360, New York (December 2, 2008, 12:00 AM EST) -- Investors seeking damages from the collapse of Cutera Inc. stock in April 2007 have filed a notice that they will appeal the dismissal of their case.

Judge Vaughn R. Walker of U.S. District Court for the Northern District of California dismissed the investors' claims on Sept. 30, saying they did not make adequate claims in their complaint. He dismissed the case without prejudice and gave the plaintiffs 30 days to file an amended complaint.

Investors brought the class action lawsuit in April 2007.
