Concarb Gets OK To Pursue Conoco Pollution Claim

Law360 (December 8, 2008, 12:00 AM EST) -- Industrial material producer Continental Carbon Co. can pursue an unjust enrichment claim against ConocoPhillips Corp. in a class action brought by an Oklahoma Indian tribe over alleged carbon contamination on their reservation, a federal judge has ruled.

In the U.S. District Court for the Western District of Oklahoma, Judge Robin J. Cauthron denied ConocoPhillips' request for summary judgment dismissing Concarb’s third-party claim against it, saying that Concarb provided solid evidence that CP may have contributed to the pollution.
