Dentists Can't Call Unrelated Acts A Conspiracy, Suppliers Say

Law360, New York (June 16, 2016, 3:21 PM EDT) -- A putative class of dentists is trying to mash together a bunch of incomparable actions and call it a nationwide antitrust conspiracy, three dental supply distributors told a New York federal court Wednesday, asking that the consolidated complaint be scrapped in its entirety.

The distributors, Henry Schein Inc., Patterson Companies Inc. and Benco Dental Supply Company Inc., said in separate filings that an 8-year-old audio recording of a meeting in Oklahoma, more-recent decisions to not attend trade shows run by organizations promoting competitors of the distributors, their alleged agreement to not poach each other's customers or workers, and other purported evidence...
