PF Chang's Appeals Data Breach Coverage Loss To 9th Circ.

Law360, Los Angeles (June 27, 2016, 5:29 PM EDT) -- P.F. Chang's has indicated it will appeal to the Ninth Circuit an Arizona federal court's decision that it isn't covered under a cyberinsurance policy for assessments MasterCard charged its card processing agent following a large-scale data breach, according to court documents filed Monday.

In a brief notice, P.F. Chang's said that it will seek the Ninth Circuit's review of U.S. District Judge Stephen McNamee's May 31 ruling that Chubb unit Federal Insurance Co. doesn't have to cover the more than $1.9 million that MasterCard charged its payment processor to deal with fallout from the breach, which compromised 60,000 credit card numbers...
