Applebee's Can't Force Discovery In FLSA Suit: Judge

Law360 (January 6, 2009, 12:00 AM EST) -- Finding that Applebee's International Inc. made an unduly burdensome request for discovery, a federal judge has rejected the restaurant chain's motion to compel interrogatories from thousands of opt-in plaintiffs in a collective action accusing the chain of paying tipped wages instead of minimum wage to servers and bartenders in violation of the Fair Labor Standards Act.
