Schering Faces Antitrust Suit Over Albuterol Prices

Law360 (January 6, 2009, 12:00 AM EST) -- Schering Corp. has been hit with a lawsuit accusing the drugmaker of reporting inflated prices for albuterol to Medicaid in violation of the False Claims Act and federal anti-kickback laws in order to boost its product over the competition.

The lawsuit, filed Monday in the U.S. District Court for the Southern District of Florida, was brought by Ven-a-Care of the Florida Keys Inc. on behalf of the United States. It also names Warrick Pharmaceuticals Corp., a Schering generics subsidiary, as a defendant.
