Fed. Circ. Nixes LendingTree Patent Claims Under Alice

Law360, New York (July 25, 2016, 9:15 PM EDT) -- The Federal Circuit ruled Monday that a district judge erred by not finding that several claims of two loan coordination patents LendingTree asserted against Zillow are invalid under Alice but remanded to let LendingTree move to vacate the invalidation of other claims.

In an oral ruling from the bench with no explanation, Judge Frank D. Whitney of Western District of North Carolina denied Zillow Inc.'s motion seeking summary judgment that the asserted claims of LendingTree LLC’s patents are invalid for claiming only an abstract idea. The Federal Circuit ruled that he should have granted the motion and invalidated the claims....
