Pokemon Go Gamer Sues App Developer Over Privacy Policy

Law360, New York (July 27, 2016, 8:47 PM EDT) -- The developer of the popular "Pokemon Go" app, Niantic Inc., was sued in Florida court Tuesday by a user who says the game's deceptive and unfair terms of service and privacy policy can't be enforced because they violate state contract laws.

Plaintiff David Beckman, who downloaded "Pokemon Go" onto his phone on July 17, 2016, said he unknowingly agreed to surrender his private and personal information to Niantic when he started playing the game, accusing the developer of providing gamers with an illusory contract that gives the company expansive rights to collect user data.
