'Green Lantern' Ruling Pressures Primary Insurers To Settle

Law360, Los Angeles (August 10, 2016, 5:26 PM EDT) -- A California appeals court's recent ruling that an excess insurer forced to pay part of Warner Bros.' settlement with an injured "Green Lantern" crew member can go after a primary insurer that refused to settle within its policy limits could have primary carriers thinking twice about rejecting lower-value settlement demands, experts say.

In a published opinion issued Aug. 4, a panel of California's Second Appellate District reversed a lower court and held that excess insurer Ace American Insurance Co. can seek to recover its portion of the settlement from primary insurer Fireman's Fund Insurance Co.
