High Court Won't Rule On Preemption In Salmon Suit

Law360 (January 12, 2009, 12:00 AM EST) -- Allowing a putative class action over alleged mislabeling of farm-raised salmon to proceed in California state court, the U.S. Supreme Court has declined to rule on whether the case might be blocked on preemption grounds by a provision in the federal Food, Drug and Cosmetic Act.
