Citing KSR, Fed. Circ. Dismisses Suit V. RealNetworks

Law360 (January 12, 2009, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit on Monday affirmed a decision to throw out a suit Friskit Inc. filed against RealNetworks Inc. in 2003 over several patents related to searching and playing back online media content, in a case that turned on the U.S. Supreme Court's decision in KSR v. Teleflex.

The appeals court upheld U.S. District Judge William Schwarzer's July 2007 decision to throw out Friskit's lawsuit, concluding that the patent claims were invalid for obviousness.
