Fed. Circ. Affirms Obviousness Ruling For SMC

Law360 (January 13, 2009, 12:00 AM EST) -- A federal appeals court has agreed with SMC Corp. and rejected a bid by Tokyo Keiso Co. Ltd. to overturn a ruling finding three claims of a patent for a meter used to measure the flow of fluids through a pipe invalid due to obviousness.

The U.S. Court of Appeals for the Federal Circuit ruled Friday that the trial court had not erred in granting SMC summary judgment on its invalidity arguments.
