Bankrupt DESA Hit With WARN Act Suit

Law360, New York (January 14, 2009, 12:00 AM EST) -- Former employees of bankrupt heater and specialty toolmaker DESA Heating LLC have filed a proposed class action claiming that the company did not give 60 days' notice when it terminated hundreds of employees last month, in violation of the Worker Adjustment and Retraining Notification Act.

The suit was filed Tuesday as an adversary proceeding in DESA's Chapter 11 case in the U.S. Bankruptcy Court for the District of Delaware. It seeks to represent a class of about 500 employees who lost their jobs when DESA shuttered...
