6th Circ. Reverses Class Cert. In Unum ERISA MDL

Law360, New York (January 15, 2009, 12:00 AM EST) -- The plaintiffs in multidistrict ERISA litigation accusing insurer Unum Group of a scheme to boost profits by illegally denying long-term disability claims are considering seeking an en banc review after a federal appeals court reversed a Tennessee judge's decision granting their bid for class certification.

In a 2-1 ruling, a three-judge panel of the U.S. Court of Appeals for the Sixth Circuit issued an opinion Monday striking down Chief U.S. District Judge Curtis L. Collier's September 2007 decision to grant the plaintiffs' bid for class certification....
