Marathon Oil Workers Lose Class Bid In OT Suit

Law360 (January 22, 2009, 12:00 AM EST) -- A federal judge has rejected a plea by former Marathon Oil Corp. workers for nationwide collective status in their wage-and-hour battle, saying the plaintiffs submitted insufficient evidence to merit even conditional certification.

Adopting the report and recommendations of a magistrate judge over the workers' objections, Judge Patrick Schiltz of the U.S. District Court for the District of Minnesota said Tuesday the plaintiffs had failed to persuade the court that it was company policy to deny workers their full dues.
