Gerber Hit With 2nd Class Action Over Fruit Snacks

Law360 (January 27, 2009, 12:00 AM EST) -- Baby food giant Gerber Products Co. is facing another class action alleging that it misled consumers by advertising its fruit juice snacks as containing more fruit than the products actually did.

Lolita Wiley filed the class action on Thursday in the U.S. District Court for the District of Massachusetts, alleging that the company promotes its fruit juice snacks for toddlers with images of fruits, including oranges, peaches, cherries, pineapples and strawberries, that are not in the product.
