Trade Groups Urge Nationwide Stay Of OSHA Reporting Rule

Law360, New York (November 2, 2016, 5:04 PM EDT) -- A Texas federal court would not be out of line in issuing a nationwide injunction to halt an Occupational Safety and Health Administration rule barring post-accident drug testing, the National Association of Manufacturers, the Associated Builders and Contractors Inc. and other groups said Tuesday.

In a supplemental brief, the groups said a nationwide injunction is not an overreach of the court’s authority because the Fifth Circuit has issued nationwide injunctions against similar rules.
