Wachovia Gets EnCap Golf's Ch. 11 Case Dismissed

Law360 (February 4, 2009, 12:00 AM EST) -- A bankruptcy judge threw out the Chapter 11 cases of EnCap Golf Holdings LLC and affiliate NJM Capital LLC, granting Wachovia Bank NA's bid to have the cases dismissed based on EnCap's failure to file a viable reorganization plan.

Judge Novalyn L. Winfield of the U.S. Bankruptcy Court for the District of New Jersey signed off on an order granting Wachovia's renewed motion to dismiss the debtor's cases for cause on Tuesday.

Debtor counsel Michael Sirota said the cases were dismissed after Encap withdrew its opposition...
