Law360, New York (February 5, 2009, 12:00 AM EST) -- A federal appeals court has reversed summary judgment in favor of the U.S. Postal Service in a suit over whether postal inspectors are eligible for overtime pay under the Fair Labor Standards Act, remanding the case to district court to determine whether inspectors are administratively exempt from the FLSA.
The U.S. Court of Appeals for the Ninth Circuit handed down the opinion Wednesday, finding that a compensation provision applicable to USPS inspectors does not necessarily trump the FLSA.
