5th Circ. Denies Forum Challenge In Exxon Fire MDL

Law360, New York (February 5, 2009, 12:00 AM EST) -- The U.S. Court of Appeals for the Fifth Circuit has rejected the attempts of a group of Louisiana plaintiffs to remand to state court the multidistrict litigation over a 1994 fire at an Exxon Mobil Corp. plant, ruling that the district court was the appropriate jurisdiction for the case to unfold.
