AMCO Off The Hook In Choice Hotels Infection Suits

Law360, New York (February 12, 2009, 12:00 AM EST) -- A federal judge has ruled that AMCO Insurance Co. does not have the duty to defend Choice Hotels International Inc. in two suits alleging guests contracted Legionnaire's disease from the pool at one of the chain's hotels.

Judge Jeanne Scott of the U.S. District Court for the Central District of Illinois ruled Monday that the insurance policy AMCO issued for the Lincoln, Ill., Comfort Inn clearly excluded coverage for lawsuits involving injuries caused by exposure to fungi or bacteria within the building.
