Volvo Gets Judge To Toss Patent Case Under Twombly, Iqbal

Law360, New York (December 19, 2016, 6:21 PM EST) -- A California federal judge has dismissed an inventor’s patent infringement suit against Volvo and others over clean energy technology, ruling that the complaint fails to state a claim for relief under the U.S. Supreme Court’s Twombly and Iqbal standards.

Judge Ronald S.W. Lew of the Central District of California noted in the Dec. 12 decision that pleading standards for patent cases have “recently undergone a shift” and became subject to Twombly and Iqbal for the first time in December 2015, after a more lenient standard was discarded in revisions to the Federal Rules of Civil Procedure.
