Wal-Mart Wins En Banc Hearing In Sex Bias Suit

Law360, New York (February 17, 2009, 12:00 AM EST) -- Wal-Mart Stores Inc. has been given a boost in its long-running battle to reverse a judge’s order granting class certification to 1.5 million women employees in a sex discrimination case, with a federal appeals court agreeing to reconsider the retail giant’s challenge.

On Friday, the U.S. Court of Appeals for the Ninth Circuit, which earlier affirmed certification of the massive class, granted Wal-Mart’s request for an en banc hearing by an 11-judge panel.
