2nd Circ. Denies Appeals From 2 Parmalat Units

Law360 (February 18, 2009, 12:00 AM EST) -- A federal appeals court has denied the appeals of two bankrupt subsidiaries of Parmalat SpA in two separate securities suits against six of the Italian dairy conglomerate’s former financial partners, which included Bank of America Corp. and Credit Suisse.

The U.S. Court of Appeals for the Second Circuit on Tuesday affirmed the dismissal of lawsuits filed by Gerald K. Smith, the litigation trustee for Farmland Dairies LLC litigation trust, and Peter G. Pappas, plan administrator of Parmalat USA Corp.’s liquidation plan.
