Twombly Leads To More Title VII Dismissals: Study

Law360, New York (February 19, 2009, 12:00 AM EST) -- New pleading standards established in the U.S. Supreme Court case Bell Atlantic Corp. v. Twombly are causing even more employment discrimination lawsuits to be tossed before trial, according to a study that will come out later this year.

The study, authored by University of South Carolina School of Law assistant professor Joseph Seiner, looked at all 532 Title VII cases that addressed a motion to dismiss in the year before and in the year after Twombly.
