Judge Lets Dr. Subpoenas Stand In Asbestos MDL

Law360, New York (February 26, 2009, 12:00 AM EST) -- A judge presiding over the asbestos product liability multidistrict litigation has denied bids by the plaintiffs' physicians to quash subpoenas of documents related to patient diagnoses, but did find the subpoenas' scope to be overly broad.

In the finding Tuesday, Judge Eduardo C. Robreno of the U.S. District Court for the Eastern District of Pennsylvania said the subpoenas were too broad and overly burdensome. He limited the subpoenas to documents related to the diagnosis of patients who have filed claims in the multidistrict litigation.
