8th Circ. Tosses Overcharging Suit V. Time Warner

Law360 (February 26, 2009, 12:00 AM EST) -- In one of the first rulings applying the filed rate doctrine to regulated cable television rates, a federal appeals court has tossed a proposed class action against Time Warner Cable Inc. that accused the cable television provider of double-billing.

In a decision issued Wednesday, the U.S. Court of Appeals for the Eighth Circuit agreed with the lower court ruling that the claims brought by the plaintiffs were barred by the filed rate doctrine.
