ERISA Class Action Against Alliant Nixed

Law360 (February 27, 2009, 12:00 AM EST) -- A federal court has granted summary judgment to Alliant Energy Corp. in a putative class action accusing the utility and a subsidiary of breaching a collective bargaining agreement by cutting retiree health care benefits.

In an order signed Thursday in the U.S. District Court for the Eastern District of Wisconsin, Judge J.P. Stadtmueller denied the plaintiffs' motion for summary judgment and granted Alliant's motion, ruling that because the collective bargaining agreements at issue in the suit did not include language regarding the vesting of health benefits,...
