Tobacco Cos. Win Dismissal Of Medicare Tax Spat

Law360, New York (March 6, 2009, 12:00 AM EST) -- A federal judge has snuffed out a suit against Philip Morris USA Inc. and other tobacco companies that sought to recover tax money spent on the treatment of Medicare patients’ tobacco-related illnesses.

Judge Raymond J. Dearie of the U.S. District Court for the Eastern District of New York on Thursday closed the case after granting the tobacco companies’ motion to dismiss the suit brought on behalf of Medicare by two taxpayer advocacy groups and a Medicare recipient diagnosed with lung cancer.
