Leibowitz's Past Opinions Point To Bolder FTC

Law360 (March 6, 2009, 12:00 AM EST) -- Though the priorities of the Federal Trade Commission under President Obama's administration are not yet clear, Chairman Jon Leibowitz's dissents and concurrences over the last several years suggest that he will take the agency in a more aggressive, pro-consumer direction on several fronts.

One of the most sweeping changes Leibowitz has suggested would be a broader, more aggressive application of Section 5 of the Federal Trade Commission Act, which prohibits “unfair or deceptive practices.”
