Winston & Strawn Malpractice Suit Transferred To Florida

Law360, New York (March 31, 2017, 3:49 PM EDT) -- A precious metal dealer's legal malpractice suit alleging Winston & Strawn LLP's advice led to a $100 million fraud penalty was transferred from Illinois to Florida federal court Thursday, after a yearlong effort by the firm to get the case tossed on jurisdictional grounds after an earlier move for dismissal narrowly failed.

After last year's motion for dismissal failed, Chicago-based Winston changed tactics, arguing it had discovered that a Washington, D.C.-based partner was domiciled in Florida. Therefore, the firm argued, Melanie E. Damian, the Florida federal court-appointed receiver for now-defunct Hunter Wise Commodities, had no grounds to file suit in Illinois....
