Patients Ask 5th Circ. To Restore $502M J&J Hip Verdict

Law360, Dallas (April 3, 2017, 7:28 PM EDT) -- Five hip implant recipients who won a $502 million verdict against DePuy Orthopaedics Inc. and parent company Johnson & Johnson on Friday told the Fifth Circuit their winnings were wrongly reduced to about $150 million under what they said is an unconstitutional cap on punitive damages.

J&J in late January argued to the appellate court the damages awarded in the second bellwether trial over its Pinnacle Ultamet line of metal-on-metal hip implants are excessive and should be either vacated or remanded for a new trial. But...
