Judge Rules IBM Didn't Violate Licensing Agreement

Law360, New York (March 10, 2009, 12:00 AM EDT) -- Granting time to amend the complaint, a federal judge Monday roundly dismissed allegations by RSI Corp. that IBM Corp. violated a licensing deal it inked for the plaintiff's data server performance software.

Judge Ronald M. Whyte of the U.S. District Court for the Northern District of California dealt RSI a resounding blow, tossing the myriad allegations in the suit, including breach of contract, fraud and unjust enrichment for failing to meet pleading requirements.
