FLSA Plaintiff Fails To Gag Papa John's

Law360, New York (March 12, 2009, 12:00 AM EDT) -- The federal district judge overseeing a Fair Labor Standards Act collective action against Papa John's USA Inc. has rejected the plaintiff's request for an order forbidding the pizza goliath from communicating with potential opt-in plaintiffs.

On Tuesday, U.S. District Judge James Gwin tossed out plaintiff Eusebius Jackson's request for both a protective order and a corrective order that would have instructed potential opt-in plaintiffs to ignore any previous communications with Papa John's regarding the lawsuit.
