Fed. Circ. Backs PTAB Nix Of Intellectual Ventures Patent

Law360, New York (April 18, 2017, 5:48 PM EDT) -- The Federal Circuit on Tuesday upheld a Patent Trial and Appeal Board decision invalidating part of an Intellectual Ventures Management LLC wireless patent challenged by Ericsson Inc., rejecting the patent licensing company’s argument that the board’s approach to finding the claims obvious was improper.

The appeals court said that PTAB’s January 2016 decision in an inter partes review saying that two of the 27 claims of the patent are invalid as obvious was supported by the evidence.
