Jury Clears Zimmer In Hip-Implant Suit

Law360, New York (May 5, 2017, 8:44 PM EDT) -- A Texas federal jury found Zimmer Inc. not liable on Friday for crippling injuries that an elderly woman believes originated with her Trilogy-line artificial hip, which she said was recalled after she had it installed.

The jury cleared Zimmer of strict liability for a manufacturing defect and for deceptive trade practices with regard to behaviors and communications relied on by the surgeon of Quitman, Texas, resident Martha Hardy, who said her Trilogy Acetabular Cup and Trilogy Acetabular Spikes “severely injured and crippled” her after her 2011 hip-replacement surgery at age 65.
