21 Club Served Up FLSA Suit Over Tips, Overtime

Law360, New York (March 18, 2009, 12:00 AM EDT) -- A group of restaurant employees on Tuesday sued the operators of the upscale New York restaurant 21 Club, claiming they illegally withheld gratuities and failed to compensate the workers for overtime.

Thirty-five plaintiffs filed the suit against 21 Club Inc. and operator Orient-Express Hotels Ltd. in the U.S. District Court for the Southern District of New York on behalf of more than 50 barbacks, bartenders, captains, waiters, bussers and sommeliers employed by 21 Club at private banquets in the past six years.
