Iowa Top Court OKs Class Cert. Of Corn Plant Pollution Suit

By Christine Powell (May 12, 2017, 7:20 PM EDT) -- The Iowa Supreme Court on Friday cemented the class action certification of a case in which residents of the city of Muscatine accuse Grain Processing Corp. of releasing pollution from its corn wet milling plant there that interferes with the use of their property, paving the way for a trial.

The state's top court affirmed the class certification in a lawsuit brought by eight Muscatine residents who live near Grain Processing's plant on behalf of themselves and roughly 4,000 other individuals, which asserts state common law and statutory claims of nuisance, trespass and negligence stemming from the alleged pollution.
