Conditional Class Cert. OK'd In United Auto FLSA Suit

Law360, New York (March 23, 2009, 12:00 AM EDT) -- A judge has granted conditional class certification in a collective action alleging that auto financing company United Auto Credit Corp. misclassified low-level supervisors as exempt from overtime compensation.

In an order Friday, Judge Ronald M. Whyte of the U.S. District Court for the Northern District of California signed off on the certification and said he viewed the requirements for conditional certification to be very liberal.
