Warner Chilcott Wins Transfer Of Ex-Sales Reps' Suit To NJ

By Nathan Hale (June 14, 2017, 8:08 PM EDT) -- A Florida federal judge on Wednesday approved the contested transfer to New Jersey of a lawsuit brought by former Warner Chilcott sales representatives, saying their challenge to a waiver of age discrimination claims is based on separation agreements that feature the forum-selection clause cited by the drugmaker.

The putative class action claims the separation agreements the sales reps signed that waived their rights to sue the drugmaker under the Age Discrimination in Employment Act are invalid after certain details emerged from an alleged physician kickback scheme that revealed a "large-scale systematic fraudulent scheme to harass and ultimately fire the experienced sales...
