Eos Settlement Over Lip Balm Injuries Fails To Clear Court

Law360, New York (June 30, 2017, 4:10 PM EDT) -- A California federal judge rejected a preliminary settlement Thursday that consumers had reached with Eos Products LLC to end two proposed class actions alleging the company's lip balm causes rashes and blisters, saying the value of the proposed settlement is too difficult to estimate.

U.S. District Judge John A. Kronstadt said that because the value of the settlement will be determined by the number and type of claims filed by class members rather than by a predetermined fund, the agreement could disproportionately benefit Eos and the attorneys.
