Merck, Gnosis Settle Vitamin False Marketing Case

Law360, New York (March 27, 2009, 12:00 AM EDT) -- Merck Eprova and rival pharmaceutical company Gnosis SpA have settled a false advertising and unfair competition suit alleging that Gnosis violated the Lanham Act when it falsely portrayed its folate-producing compound as equivalent in potency and purity to Merck's version.

United States District Judge Richard J. Sullivan of the U.S. District Court for the Southern District of New York on Wednesday dismissed the case with prejudice but without costs, saying that either party could apply to restore the action within 30 days.
