Fed. Circ. Knocks Gilstrap's Denial Of Genband Injunction

Law360, New York (July 10, 2017, 9:39 PM EDT) -- The Federal Circuit on Monday faulted Eastern District of Texas Judge Rodney Gilstrap's decision not to impose a permanent injunction on Metaswitch after it was found to infringe Genband's telecommunications patents, saying he possibly used too strict a test to make his decision.

A jury found last year that Metaswitch Networks Corp. infringed seven Genband US LLC patents covering voice over internet protocol services and must pay $8.2 million in damages. Judge Gilstrap then denied Genband's motion to bar sales of the infringing products, saying it had not shown that it would suffer irreparable harm from Metaswitch's continued infringement.
