3rd Circ. Revives Ex-Chesapeake Workers' Discrimination Suit

Law360, Philadelphia (July 14, 2017, 6:50 PM EDT) -- The Third Circuit issued a published decision Friday reviving workplace harassment claims from a pair of former contract workers for Chesapeake Energy Corp., as it ruled that a single use of a racial epithet was sufficient to bring suit.

A three-judge panel concluded that the case had been improperly dismissed based on a trial court's conclusion that the alleged harassment the two workers faced, including a supervisor's use of the N-word, was not "pervasive and regular" enough to proceed.
