Sandoz, Ratiopharm Infringe Oxycontin Patents: Court

Law360 (April 1, 2009, 12:00 AM EDT) -- A U.K. appeals court has determined that generic-drug makers Sandoz Ltd. and ratiopharm GmbH have infringed the patents of Purdue Pharma LP affiliate Napp Pharmaceutical Holdings Ltd. for the painkiller Oxycontin.

The Court of Appeal of the Supreme Court of Judicature in London overturned in part a lower court ruling that had found two U.K. patents for the drug valid but not infringed. It rejected an appeal from the German generics claiming the patents were invalid, upholding a finding of validity.
